Two Cheers for Interdiction and Restitution!


A good post from Tess Davis following up on the Huffington Post piece she did with Mark Vlasic. I'd only add that while it is indeed laudable that the FBI et. al. are having some success nabbing individuals who are smuggling already looted artifacts, this doesn't really address the fundamental problem of how to prevent looting going forward, since the demand is global and effective interdiction difficult. Interdiction and restitution on a country-by-country basis, assisted by the always-understaffed INTERPOL, are necessary but not sufficient. And while it would be thrilling if the world could be persuaded to stand together and institute -- not to mention enforce -- a global ban on trade in antiquities, that is not going to happen. The real answer has to lie in providing more and better resources to those who are trying to guard and protect their own archaeological sites.

There is, in fact, some reason to worry about the otherwise happy-making emphasis on high-profile seizures and restitution.  Catching a few dealers here and giving stuff back might well be a policy substitute rather than a complement to developing policies that would actually protect the sites themselves.  And there's good reason to believe that our government might prefer seizure and restitution to site protection support. That's because, as Davis and Vlasic note, restitution, with its high-profile newsworthiness, is a handy tool for mending diplomatic fences, much sexier than, say, giving some remote sensing devices to the Cambodian antiquities police. Just as in Iraq, where Babylon was restored while thousands of sites were left unprotected, so more generally, splashy seizures may just mystify and obscure negligence about the real and more intractable issue, which is how to keep the looters from reducing sites to rubble in the first place.

A Rejoinder to Neil Brodie

As Neil Brodie's response to my original post below makes clear, we agree on much more than we disagree on, including the importance of engaging local communities in site protection efforts, and on the fundamental importance of linkage (on which more below. And as I suspected, at least some of our disagreements are not substantive but semantic. As a policy researcher I tend to think of "effort and resources" as terms that refer to what the government or military actually provides to the archaeologists, museum curators, police, and military personnel -- not to the efforts that archaeologists, museum curators, police, and military personnel expend in order to try to persuade the government or military leadership to empower them. In his response, Neil comes some way towards making this distinction as well. 

But even with this distinction in place, we continue to disagree. This is a question of evidence. Neil seems to believe that the focus in Iraq by archaeologists, curators and military personnel, advocacy-wise, was exclusively on site protection; and because the sites were not protected, this proves that advocating for site protection is a waste of time in all circumstances. 

That strikes me as logically fallacious. But it also seems mistaken as a matter of evidence. I think the record shows that archaeologists, curators, and military personnel concerned about Iraq's archaeological heritage did not in fact make site protection the exclusive focus of their advocacy efforts. In fact, because archaeologists and conservation groups themselves are neither trained nor interested in how to secure sites, it wasn't even the central focus of their advocacy efforts. Of course they castigated and chastised the military, and rightfully so. But look at what they asked for or willingly accepted from government and from foundations, and where the money went: into training conservators and archaeologists, into GIS mapping systems, into rebuilding the museum, into turning Babylon into a tourist attraction, into decks of playing cards to sensitize GIs about the need to do no harm to sites (but not to guard them), into cultural sensitivity awareness-raising talks by the head of the AIA to officers headed overseas. All fine things, but not related directly to stopping looting. In contrast, it took years for Elizabeth Stone to find the money to buy satellite photos simply to be able to document the massive looting that had occurred. And in the absence of that documentation, the Bush administration was permitted to not have to take responsibility for protecting the sites -- while it could, on the other hand, speak proudly about funding these conservation and cultural-sensitivity-training efforts. Oh, and also speak proudly of backing UNSCR 1483 and imposing its own emergency ban on imports of Iraqi materials into the US. Meanwhile thousands of sites were looted.

That does not mean that UNSCR 1483 was ineffective, necessarily. Indeed, Stone believes it accounts for the decline in looting that eventually did occur, though of course the caveat here is that looting continues at a higher level than in earlier times when the antiquities police were stronger (and as Stone herself admits, another possible cause for the decline in looting may be that after three years of massive digging the market was saturated). The point is that it is that we need both more and better supply-end policing and more and better demand-side policing.

Neil, by contrast, suggests that the solution is trade regulation at the international level. Exactly what that would mean I am not sure. But if he has in mind a worldwide ban like that imposed by 1483, now applied to all antiquities whatsoever, I am puzzled. Such a ban would be lovely, of course. But what chance is there of passing such a ban? And if passed, how would the sustainable resources for enforcing the ban be found?

My opinion is that a worlwide ban enforced by robust international policing is pie in the sky. It is almost impossible to imagine it being put in place to begin with, and if it were, it is equally difficult to imagine the international community coming up with the money to make it effective. 

Which brings me to "linkage". Neil and I agree wholeheartedly that it is the buyers of antiquities who fuel the looting, and that therefore any sustainable solution to the problem of looting must recognize the linkage between collecting and looting. But where I think we may differ is that I want a policy that makes this linkage work for our purposes, a policy that would link collecting not to looting but to looting prevention (as well as to policing of the illicit international trade, which would require sustained funding of criminological research of the kind that Neil does so brilliantly). 

As I have argued for quite some time now, one feasible way to begin doing this would be to tax domestic purchases of antiquities and direct the proceeds into policing efforts -- including funding international taskforces, domestic undercover operations and other activities in destination countries, but also including funding for site protection efforts of various sorts in "countries of origin". This proposal is far from what the collectors have in mind when they call for site protection. I agree with Neil that in their case the call is a way of trying to shirk responsibility and shift guilt. My proposal forces collectors to take economic responsibility and is modeled on the "sin tax" model of public policy, so I'm not sure why Neil thinks what I am suggesting sounds like what the collectors say.

US-Iraq Joint Coordinating Committee for Cultural Cooperation -- Preserve, But Don't Bother to Protect

The US-Iraq Joint Coordinating Committee for Cultural Cooperation has released a fact sheet. Here's what they are up to in the area of cultural heritage:

The United States, Iraq, and premier American academic institutions, museums, and NGOs are collaborating to ensure sustainable preservation of Iraqi national sites, monuments, and collections of world importance. The U.S. Embassy in Baghdad has committed $550,000 to continue support for the educational programs of the Iraqi Institute for the Conservation of Antiquities and Heritage (IICAH) in Erbil through 2013. The Institute has also recently secured $650,000 in funding from private American foundations to continue its education and training programs. U.S.-supported infrastructure upgrades to the National Museum of Iraq are complete, and the U.S. is now assisting site management and preservation of the ancient site of Babylon through a $3.7 million grant to the World Monuments Fund. The United States supported a month-long residency at the Metropolitan Museum of Art for Iraqi museum professionals in fall 2011 and will host Iraqi graduate students in the summer of 2012 as part of the Iraqi Museum Residencies Program.

All these are wonderful projects, and are, one might suggest, the least the US could do to help after having wrecked Iraq. But it is important to note that aside from the infrastructure upgrades to the Iraq Museum, which one presumes includes paying for the barbed wire and other security improvements, nothing on this list addresses the concern for protecting Iraq's cultural heritage from the threat of antiquities looting. The notion that tourism is going to ensure "sustainable preservation" for the entirety of a country's heritage -- not just for a Babylon or Pompeii -- is a dubious one even for countries in which tourists need not fear for their safety and in which there is not a plethora of difficult-to-reach, seemingly innocuous or even downright ugly (=untouristworthy) sites, including of course the totally untouristable undug sites, which are precisely those about which we should be most concerned. Those sites are going to remain tempting targets for looters, and to preserve them will require police, not educators or museum professionals. Yet not a cent appears to have been allocated toward antiquities policing assistance: no money for guards, no money for developing locally based citizens' groups to help Iraqi antiquities police monitor remote sites, no logistical support in the form of equipment, vehicles, walkie talkies, etc. It is understandable that the US and Iraqi governments both should wish to behave as if antiquities looting did not pose a problem going forward -- for the US this see-no-evil attitude is nothing new, since even when massive looting was occurring almost no attention was paid by coalition forces. Let us hope that security in general does not devolve and that the Iraqi government has the will to itself eventually more fully invest again in the kind of robust antiquities policing and site guard system it once had but which it has failed to rebuild completely since regaining its sovereignty.

After Iraq National Archives, after Baghdad Museum, after Cairo Museum, Why Was Egypt's Library Not Secured?


The burning of the Egyptian Scientific Institute in the midst of the chaos in Cairo is a cultural disaster on a par with the worst acts of destruction of heritage in recent years, arguably worse than the losses to the Iraq Museum (since stolen artifacts can still be recovered, whereas the burned original manuscripts are gone forever). Whether the fire was started by a Molotov cocktail or, as some have asserted, was set by the soldiers inside the building, is not yet clear, and may never become clear. What is clear, however, is that the burning of this library reflects yet another abject failure of heritage policy to protect heritage when it is most at risk.

It is not as if this eventuality was unpredictable. After the Cairo Museum was robbed in the midst of similar chaos last January, the Egyptian government, and the military leaders who run the country, should have been able to work with international heritage protection agencies and organizations such as UNESCO, the Blue Shield,and others -- including the many, many Egyptian citizens who care deeply about their heritage (and showed it by joining hands to cordon off the Cairo Museum in January) -- to put in place contingency plans to keep cultural institutions secure during periods of unrest. Last but not least, the US government, which subsidizes Egypt's military to the tune of billions, ought to have demanded the Egyptians secure their cultural institutions and sites as a condition of aid. But of course, since we have no carabinieri-like forces ourselves to do this sort of thing, and little interest ourselves in securing cultural sites apart from major tourist attractions such as the Baghdad Museum or Babylon, chances are that no one from the Pentagon was even thinking about the problem, even after the looting of the Cairo Museum.

That was in January. Did the fate of the Cairo Museum provide a wakeup call that site security needed to be an urgent policy priority? It was not until mid-October, after months of bureaucratic chaos, that the government announced it had set up a committee to develop security plans, so the answer is most likely no. Nor did any citizens' groups evolve out of the noble ad hoc handholding at the museum.

The result? If this CNN report is accurate, the military did not set up a perimeter around the building. Instead, a small number of soldiers stood on the building's roof and goaded the protestors:

The library was a scene of intense confrontation Saturday.

A dozen men dressed in military uniform were positioned on the library roof and threw cement blocks and rocks on the protesters and sprayed them with water hoses to push them away from the building.

But protesters hurled back rocks as well as Molotov cocktails. Then a massive explosion erupted, apparently originating from inside the building, and black smoke billowed.

Firefighters were busy putting out another fire in a nearby building.

Protesters were bleeding from rocks thrown at them.

What is to be done going forward, beyond the important immediate task of salvaging the remnants of the library?

First, the courage, energy, and passion that Egyptian citizens have shown in responding to the disasters at the museum and now at the library needs to be channeled into civic organizations that can be mobilized proactively next time around.

Second, UNESCO needs to either shift resources from conservation and development or supplement them with additional funding focused on securing cultural sites during periods of political unrest.

Third, the United States needs to exercise some leadership and influence, where it has leverage or ties with militaries in countries undergoing transitions or crises, to induce them to do the right thing.

Fourth, NGOs and foundations that support cultural heritage conservation need to begin thinking about how they can work directly with nascent heritage site protection NGOs in-country.

Profile of State Department's Archaeologist in Afghanistan

Excellent profile of Laura Tedesco, who as the State Department's archaeologist in Afghanistan is doing even more dangerous duty than her colleagues in Iraq, the only other country, as the article notes, where the State Department has posted an archaeologist. It takes great courage and commitment to put one's body on the line as archaeologists in both countries have done, and they deserve our gratitude for that.

As a matter of policy, it is interesting to compare the approach taken in the two countries. In Iraq, the focus has been on redeveloping Babylon and restoring the Iraq Museum as heritage tourism destinations, with little attention paid to the massive destruction of other sites by looting or encroachment. In Afghanistan, in contrast, the focus has been on one extraordinary recently deiscovered archaeological site, at Mes Aynak, that is certain to be destroyed, even though it could in theory have become a major tourist attraction if it did not sit atop mineable natural resources worth far more than tourism could ever generate. Tedesco is coy about how much is being spent on salvaging what can be saved from Mes Aynak, but admits it runs into the millions. It is worth asking how much might have been saved from being destroyed by antiquities looters in Iraq if the policymakers at the State Department and in the Pentagon had recognized that there was an equivalent need to protect Iraq's threatened archaeological heritage, and not just to exploit the part of it that would generate tourist revenues.

The Waters of Babylon


The New York Times reports on a major undertaking by the World Monument Fund and Iraq's State Board of Antiquities and Heritage, financed (at least for the assessment and preliminary management planning phase) by the State Department. The last paragraph raises obliquely a criticism of the way in which postwar funding for archaeological concerns may have skewed towards producing more archaeologists, to the neglect of beefing up other kinds of expertise also needed to do the dirty, unglamorous jobs of shoring up buildings, pumping out or diverting water -- and, one might add, securing, monitoring and patrolling sites against looters:

The site was returned to Iraqi control more than a year ago. Ms. Ackerman and Mr. Allen said the project had already surveyed the remains, building by building, and started the restoration of two museums. Although Iraq has a large corps of trained archaeologists, they said, an immediate need is to instruct others in the conservation of ruins and bring in structural engineers and hydrologists to handle the water problem.

guest post from Maj. Corine Wegener on Kaylan's downplaying of damage to Iraq's cultural heritage during the U.S. occupation

Corine Wegener, a now-retired major in Civil Affairs who deployed to Iraq after the looting of the museum to assist in mitigating the damage there, is now President of the U.S. Committee of the Blue Shield, has written a letter to the editor of the Wall Street Journal responding to Melik Kaylan's article there. She has kindly agreed to allow me to post it here as well:

To the Editor:

Melik Kaylan’s efforts (Nov. 13, 2009, Myths of Babylon) to downplay damage to Iraq’s cultural heritage during the U.S. occupation actually do a disservice to our military and carry political overtones which serve neither our troops nor our reputation on the international stage. In 2003-2004, I served in Baghdad as the Arts, Monuments, and Archives Officer for the 352d Civil Affairs Command. Inadequate planning for the protection of Iraqi cultural property prior to the invasion of Iraq resulted in harm to an ancient cultural heritage shared by us all, and it could have been prevented.

As much as I respect Chaplain Marrero and the Marines’ efforts to secure Babylon in 2003, the subsequent damage done by contractor KBR’s continuously improving and expanding the site as an operating base was significant and avoidable. That Babylon had suffered damage under Saddam’s regime does not make additional damage while under the control of Coalition Forces any more acceptable to the Iraqi people or the international community. Damage did occur at many sites, and certainly did not help us to win hearts and minds.

The U.S. Committee of the Blue Shield, a nongovernmental organization founded in 2006, has provided cultural property training to dozens of deploying U.S. Army Civil Affairs units. Informed with this training, military personnel demonstrate an understanding and respect for local cultural heritage that helps build relationships and, ultimately, saves lives. We do not believe diminishing or denying the mistakes of the past will move us forward. The U.S. military has a proud tradition for respecting cultural heritage that goes back to WWII - we must rebuild that reputation and provide military personnel with the tools and training they need to accomplish their mission while preserving cultural heritage for future generations.
